The advocat’s fee is formed in compliance with the requirements of the Law of Ukraine “On the Bar and Practice of Law” dated July 5, 2012 by the advocate himself.
According to Art. 30 of the Law of Ukraine “On the Bar and Practice of Law” and Articles 28, 29, 30 of the Rules of Advocate Ethics, approved by the Reportable and Elective Congress of Advocates of Ukraine on 04/09/2017, the fee is a form of remuneration for an advocate for providing protection, representation and providing other types of legal aid assistance to the client.
The procedure for calculating the fee (fixed amount, hourly payment), the grounds for changing the amount of the fee, the procedure for its payment, terms of return, etc., are defined in the agreement on the provision of legal aid assistance.
The amount of the fee is determined by agreement between the advocate and the client.
The advocate has the right to determine the amount of the fee within reasonable limits, based on his own considerations. When determining the amount of the fee, the complexity of the case, qualification, experience and workload of the advocate and other circumstances may be taken into account. Agreed by the advocate with the client and/or the person who concluded the agreement in the interests of the client, the amount of the fee can be changed only by mutual agreement.
In case of particularly complex assignments of the client or in the event of an increase in the amount of time and work of the advocate for the actual performance of the assignment (preparation for performance), the amount of the fee may be increased by mutual agreement.
Disagreement by the client and/or the person who entered into the agreement in the interests of the client with the amount of the fee when giving the mandate to the advocate, or during its performance , is grounds for the advocat’s refusal to accept the client’s mandate or termination of the agreement at the request of the advocate.
The advocate has the right to demand from the client and/or the person who concluded the agreement in the interests of the client, advance payment of the fee and/or compensation for possible expenses related to the performance of the assignment.
By decision of the Bar Council of the Kharkiv region No. 13/1/7 dated 07/21/2021, the amount of (minimum) advocate fee rates was established.
